In framework of permanent cooperation wih United Nations’ structures, bodies and agencies, our Associaiton sent to UN Committee on the Elimination of Racial Discrimination own comments for drafting the General Recommendation N° 37 on racial discrimination in the enjoyment of the right to health that started at its 109th Committee’ session in April 2023.
Association’s comments, prepared by proffessor Borys Babin and publshed on UN web-sources now, stress that occupying “administrations” provide access to medic services in the Russia-occupied Crimea, only for persons who were forced to get illegal “Russian passports and certificates”, with clear discrimination of ethnic Ukrainian and indigenous Crimean Tatars. Also, as comments stress, right to privacy in medic issues is totally violated by Russian illegal “administrations” on Russia-occupied territories of Ukraine, as on mainland, so in Crimea.
Association’s comments supported the mentioning in point 10 of draft of Recommendation that conflicts and internal displacement, often result deprive individuals and groups from the regime of protection against racial discrimination, including special measures. Also Association stressed that the issues of elimination the racial discrimination in right to public health, medical care, social security and social services must be reflected in Draft separately, regarding situations of conflict in framework of relevant provisions of international humanitarian law and international criminal law including Rome Statute and international standards of indigenous right to health.
Association’s comments added that special attention must be paid to article 6 “Genocide” of Rome Statute regarding issue of deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; and to article 7 of that Statute regarding “extermination” that includes the intentional infliction of conditions of life, inter alia the deprivation of access to food and medicine, calculated to bring about the destruction of part of a population.
