In framework of permanent co-operation with UN bodies, agencies and officials, our Association sent submission to UN Expert Mechanism on the Rights of Indigenous Peoples for its Study on constitutions, laws, legislation, policies, judicial decisions and other mechanisms through which States have taken measures to achieve the ends of the UN Declaration on the Rights of Indigenous Peoples, in consultation and cooperation with such peoples in accordance with article 38 of the Declaration.
Now UN published ARC’s submission, prepared by Professor Borys Babin, also as that Study A/HRC/EMRIP/2024/2, including Expert Mechanism Advice No. 17 (2024) on how States should take such measures to achieve the ends of the Declaration within the context of their human rights obligations and responsibilities.
Study thanked all NGO for submissions and Advice stated that Indigenous Peoples should continue to build their own institutional capacity and expertise on their rights affirmed in the Declaration and on how to enforce them at the national, regional and international levels, including by participating in lawmaking work by expanding their opportunities to exercise legislative initiative and to participate directly in parliaments of all levels.
ARC’s submission on that issue reminded to UN Expert Mechanism that our Association addressed in 26th of October, 2022 to all Indigenous Peoples of the world to recognise, by decisions of their representative structures and other organisations, the Russia as state and Russian politic regime, which destroy the Indigenous Peoples of Ukraine by its terroristic attacks as terroristic organisations and sponsors of terrorism, and to address the national and regional assemblies of their states the same demand.
ARC’s submission stressed that in Ukraine the sublegal acts were drafted developing the Law of Indigenous Peoples of Ukraine with participation of Mejlis of Crimean Tatar People and independent experts, including our Association’s representatives, such as Dr. Babin.
ARC’s submission added that in July, 2023, Mejlis of Crimean Tatar People asked officially Cabinet of Ministers of Ukraine to establish the legal status of Mejlis as the representative body of Indigenous People of Ukraine, implementing procedure under Resolution 2022, № 936, and gave demanded documents to Ukrainian Government, but till this date Ukrainian Government did not finalize this procedure.
ARC’s submission stressed in submission on importance of academicians’ and NGO activities on issues of achieving the ends of the Declaration, including positive example of sessions of Strategic Forum “Future of Crimea”, initiated by the Crimean Tatar Resource Center with ARC’s experts active participation.
