In framework of permanent co-operation with UN bodies and agencies our Association sent submission to UN Special Rapporteur on counter-terrorism and human rights Professor Ben Saul for his thematic report on the protection of human rights by regional organizations when countering terrorism to be presented to the UN General Assembly.
ARC’s submission, prepared by Dr. Borys Babin and published at UN sourses now, reminded that politicization and obviousness of Russian aggressor’s international crimes, accompanied by statements and demands from both the leaders of the occupying “authorities” in the Crimea, Henichesk, Melitopol, and the Russian leadership as a whole, has all the signs of state terrorism, and that the Parliamentary Assembly of the Council of Europe determined at October 2022, the current Russian regime as a terrorist one.
ARC’s submission also reminded about decisions of European Court on Human Rights in interstate cases, where activities of the Russia-controlled terrorists was described, so Russian illegal activities in Crimea, established by this ECtHR’s decision, have direct terroristic nature.
ARC’s submission also pointed on Judgment of International Court of Justice, in case 166 that Russia has violated its obligations under the International Convention for the Suppression of the Financing of Terrorism as it did not take necessary measures under its “domestic law” to investigate the terrotistic activities of own proxies.
ARC’s submission added that Russian diplomacy and propaganda tried to use regional structures such as Collective Security Treaty Organization (CSTO) and Shanghai Cooperation Organisation (SCO) to disseminate relevant fakes on alleged Ukraine’s relations with Crocus City Hall attack, but those regional structures refused to support Russia on those provocations.
In his relevant Report A/79/324 “Promotion and protection of human rights and fundamental freedoms while countering terrorism” Special Rapporteur recognised, on example of SCO, that “vagueness and overbreadth enable the politicized misuse of counter-terrorism laws and infringements of many fundamental rights” and “these problems are aggravated in regional instruments because misuse can occur not only in national implementation but also through transnational cooperation facilitated by the instruments”.
It is notable that Special Rapporteur did not include any Russia-coorganised or Russia-controlled regional international structure, like SCO or CSTO into list of Principal regional counter-terrorism entities, annexed to Report A/79/324.
