In framework of permanent cooperation with UN Human Rights Council our Association sent submission to UN Special Rapporteur on the right to adequate housing, Mr. Balakrishnan Rajagopal, for his report to Council regarding guidelines at the international level to ensure that resettlement and relocation are carried out in compliance with the international human rights framework and are consistent with the Sustainable Development Goals.
ARC’s submission, prepared by Professor Borys Babin and published on UN sources stressed again that Russia’s destruction the Kakhovka HPP dam created new wave of migration without resettlement possibilities that has features of genocide. ARC stressed in Crimean examples that regarding resettlement issues specific situation must be taken into account: of enforced “patronage” and “adoption” and keeping in orphanages with artificial change of children personal data, including names, origin, parents’ names that make impossible effective research of deported child.
ARC added that regarding migrants’ rights in resettlement situation special attention must be paid to indigenous migrants regarding their rights, guaranteed by UN Declaration, 2007, including cultural and spiritual rights and right to return on historic native land. Also, ARC pointed that regarding migrants’ rights in resettlement situation in conditions on hostilities and interstate conflict demands of Rome Statute, Geneva Convention and Additional Protocols must be taken in account regarding war crimes and crimes against humanity committed as enforcement disappearances.
