In the framework of permanent cooperation with the United Nations’ bodies and institutions, our Association sent a submission to the UN Special Rapporteur on the Human Rights of Migrants, Dr. Gehad Madi, for the preparation of his next report on the children’s right to family life in the context of migration and asylum policies.
The ARC submission, prepared by Andrii Chvaliuk, Olexiy Plotnikov and other experts, and published at the official UN web-sources now, stressed that the criminal groups that use child sexual abuse and child trafficking in the Crimea, were subordinated and closely cooperate with the Russian de facto “authorities”, which control illegal “child protection services” for last decade in the peninsula.
The submission added that in Russia-occupied mainland territories of Ukraine illegal “child protection services” are used by invaders for illegal pressure and threat against families of children, which allegedly sympathize with Ukraine, use tools of distance education by Ukrainian school programs and refuse to take “Russian citizenship documents”.
Such threats and actions of illegal “child protection services” includes participation in deportation, enforced labour, fines, imprisonment and “deprivation of parental rights” for parents, also as hate speech, indoctrination and forced “registration” in the aggressor’s local “military registration and enlistment offices”.
The ARC submission proposed to the UN Special Rapporteur to concentrate additional attention on children’s right to family and to an effective remedy, including he subjectivity of children as victims that is violated during illegal adoption, changing name and nationality of a child; the usage of deported, displaced and resettled children as hostages to block and delay the procedures of remedies for their violated rights; the specialty of restitution and compensation of moral damage caused to child and methodic of such damage calculation; the specialty of legal protection of rights and interests of indigenous children; and of children in conditions of armed conflict and residing in zones of foreign military control.
Issues of legal subjectivity and responsibility of artificial intelligence, involving the violation of rights of children, child discrimination, illegal exploitation, and abuse, as of its creators and coordinators, must also be researched, the submission added.
