In framework of permanent cooperation with United Nations’ bodies and agencies our Association sent submission to inform the Special Rapporteur on the sale, sexual exploitation and sexual abuse of children Ms. Fatima Singhateh for her final report of the to the 61st session of the Human Rights Council, pursuant to the Council’s Resolution 52/26.
ARC’s submission, published at UN official web-sources now, reminded to UN officials that the participation of the Crimean organised criminal groups in sexual exploitation of youth, posed additional challenges to the identification of victims as there are no effective remedies in the occupied peninsula as a “grey zone”, as Russia illegally applies its own legislation on occupied territory since 2014, and illegal “child protection services”, created in the Crimea, never reacted on those challenges.
ARC’s submission added that in Russia-occupied mainland territories of Ukraine illegal “child protection services” are used by invaders for illegal pressure and threat against families of children, which allegedly sympathize with Ukraine, use tools of distance education by Ukrainian school programs and refuse to take “Russian citizenship documents”.
Such threats and actions of illegal “child protection services” includes participation in deportation, enforced labour, fines, imprisonment and “deprivation of parental rights” for parents, also as sexual violence and threats of such violence, hate speech, indoctrination and forced “registration” in the aggressor’s local “military registration and enlistment offices”.
ARC proposed in its submission to the Special Rapporteur to concentrate additional attention on such challenges, as subjectivity of children as victims that is violated during illegal adoption, changing name and nationality of a child; usage of deported, displaced and resettled children as hostages to block and delay the procedures of remedies for their violated rights; specialty of restitution and compensation of moral damage caused to child and methodic of such damage calculation; specialty of legal protection of rights and interests of children, who become victims of illegal behavior with non-determined personal target such as hate speech, racist statements and genocidal calls.
ARC’s submission added that issues of legal subjectivity and responsibility of artificial intelligence, involved into violation of rights of child, into children discrimination, illegal exploitation and abuse also as of its creators and coordinators, must be researched, also as the specialty of legal protection of rights and interests of children, who are victims or applicants in international legal proceedings and specialty of legal protection of rights and interests of indigenous children and children in conditions of armed conflict and residing in zones of foreign military control.
